Terms of Service
§ 1. GENERAL PROVISIONS AND CONTACT DETAILS
The Online Store operating at the website address selico.eu (hereinafter referred to as the "Store") is run by:

(hereinafter referred to as the "Seller" or "Administrator").

These Terms of Service are addressed to both Consumers and Business customers using the Store, unless a specific provision states otherwise and is addressed exclusively to Consumers or Businesses with Consumer rights.
Prices given in the Store are gross prices (including VAT) expressed in Polish złoty (PLN).
Announcements, advertisements, price lists and other information about Products provided on the Store's website, in particular their descriptions, technical and usage parameters, and prices, constitute an invitation to conclude a contract within the meaning of Article 71 of the Civil Code Act of 23 April 1964.
§ 2. DEFINITIONS
Seller – SELICO Spółka z o.o. with its registered office in Poznań at ul. Sielska 17A, 60-129 Poznań, Tax ID (NIP): 5273144522, REGON: 540496678, KRS: 0001146327.
Customer – a natural person, legal person, or organizational unit without legal personality granted legal capacity by law, placing an Order in the Store.
Consumer – a natural person performing a legal transaction with an entrepreneur that is not directly related to their business or professional activity (Article 22¹ of the Civil Code).
Business with Consumer Rights – a natural person entering into a Sales Agreement directly related to their business activity, when the content of that agreement shows that it does not have a professional character for that person, resulting in particular from the subject of the business activity they conduct, made available under the provisions on the Central Registration and Information on Business.
Product / Goods – a movable item available in the Online Store that is the subject of a Sales Agreement between the Customer and the Seller.
Sales Agreement – a distance sales agreement for Goods concluded between the Customer and the Seller via the Online Store.
Order – the Customer's declaration of intent aimed directly at concluding a Sales Agreement for Goods with the Seller.
Digital Services Act (DSA) – Regulation (EU) 2022/2065 of the European Parliament and of the Council of 19 October 2022 on a Single Market For Digital Services and amending Directive 2000/31/EC.
§ 3. TECHNICAL REQUIREMENTS AND THE SERVICE'S ROLE (DSA)
To use the selico.eu Online Store, the following are required:
A device with internet access,
A web browser (e.g. Chrome, Firefox, Safari, Edge) with JavaScript and Cookies enabled,
An active email account.
The Customer is prohibited from providing content that is unlawful, infringes personal rights, copyright, or good practice.
Designation of a point of contact for DSA purposes:
The Seller designates the email address: kontakt@selico.eu as the direct point of contact for the authorities of Member States, the European Commission, the Digital Services Board, and recipients of the service. Communication is conducted in Polish and English.
Procedure for reporting and removing illegal content:
Any person or entity may report to the Seller the presence of information they consider illegal content on the service. Reports should be sent to the email address: kontakt@selico.eu.
The report should include: an explanation of the reasons, the exact location (URL), and the reporting party's details. The Seller promptly reviews the report and decides whether to remove or block access to the content, notifying the reporting party of the decision.
§ 4. PLACING ORDERS AND CONCLUDING THE AGREEMENT
Orders can be placed in the selico.eu Store 24 hours a day, 7 days a week.
To place an Order, the Customer:
Selects Products, adding them to the virtual cart,
Fills in the order form, providing the data necessary to complete the transaction (first and last name, delivery address, email address, phone number),
Selects the delivery method and payment method,
Accepts the Terms of Service and confirms placing the order with an obligation to pay by clicking a button labeled "Order with obligation to pay" (or an equivalent).
After the Order is placed, the Seller promptly confirms its receipt and accepts the Order for fulfillment by sending an email to the address provided by the Customer. The Sales Agreement is concluded at the moment the Customer receives this message.
§ 5. PRICES, PAYMENTS AND INFORMATION ON PRICE REDUCTIONS (OMNIBUS DIRECTIVE)
All prices given in the Store include VAT and are expressed in Polish złoty.
When a promotion or price reduction for a Product is introduced, alongside the current promotional price the Seller displays the lowest price of that Product that applied during the 30 days before the price reduction was introduced. If the Product has been offered for sale for a period shorter than 30 days, the lowest price is shown from the date the Product was first offered.
The Store offers the following payment methods:
Electronic payments and payment card transactions via Przelewy24 (the payment operator is PayPro S.A., with its registered office in Poznań at ul. Pastelowa 8, 60-198 Poznań, KRS: 0000347935, NIP: 7792369887),
Mobile payments via BLIK, processed through the Przelewy24 system,
Instant bank transfers (pay-by-link).
The Customer is required to make payment promptly after placing the order, unless cash-on-delivery payment has been selected (if such an option is available).
§ 6. DELIVERY AND COLLECTION
Products are delivered within the territory of the Republic of Poland and selected European Union countries indicated in the Store's cart.
Delivery is carried out via the courier company DHL (DHL Parcel Polska Sp. z o.o.).
Delivery costs are clearly indicated to the Customer while placing the Order in the cart.
The order fulfillment time is usually 1 to 3 business days, unless a different timeframe is stated for a given Product. This time is counted from the moment payment is credited to the Seller's account.
§ 7. RIGHT OF WITHDRAWAL FROM THE AGREEMENT (RETURNS)
The Consumer and a Business with Consumer Rights have the right to withdraw from a Sales Agreement concluded at a distance within 14 days without giving any reason.
The withdrawal period begins when the Consumer, or a third party other than the carrier indicated by the Consumer, takes possession of the Goods.
To exercise the right of withdrawal, the Consumer must inform the Seller (SELICO Sp. z o.o., ul. Sielska 17A, 60-129 Poznań, email: kontakt@selico.eu) of their decision by means of an unequivocal statement (e.g. a letter sent by post or email).
The Consumer may use the model withdrawal form provided as Annex 1 to these Terms of Service, although this is not obligatory.
To meet the deadline, it is sufficient to send the statement before it expires.
Effects of withdrawal from the agreement:
In the event of withdrawal from the agreement, the Seller shall refund to the Consumer all payments received, including the cost of delivering the goods (except for additional costs resulting from the Consumer's choice of a delivery method other than the cheapest standard delivery method offered by the Seller), promptly, and in any case no later than 14 days from the day the Seller was informed of the decision.
The refund will be made using the same payment method used by the Consumer, unless the Consumer has expressly agreed to a different solution; in any case, the Consumer will not incur any fees in connection with this refund.
The Seller may withhold the refund until the Goods have been received back, or until proof of their return shipment has been provided.
The Consumer is obliged to return the Goods to the address: SELICO Sp. z o.o., ul. Sielska 17A, 60-129 Poznań, promptly, and in any case no later than 14 days from the day on which they informed the Seller of the withdrawal from the agreement.
The Consumer bears the direct cost of returning the Goods (sending the item back to the Seller).
The Consumer is only liable for any diminished value of the Goods resulting from handling them in a way other than what was necessary to establish the nature, characteristics, and functioning of the Goods.
§ 8. COMPLAINTS AND LIABILITY FOR CONFORMITY OF GOODS WITH THE AGREEMENT
The Seller is obliged to deliver Goods to the Customer that conform with the agreement.
The provisions of Chapter 5a of the Consumer Rights Act (lack of conformity of goods with the agreement) apply to Sales Agreements concluded with Consumers and Businesses with Consumer Rights.
Goods conform with the agreement if, in particular, their description, type, quantity, quality, completeness, and functionality conform with the agreement.
The Seller is liable for any lack of conformity of the Goods with the agreement that existed at the time of delivery and is discovered within 2 years of that time.
In the event of non-conformity of the Goods with the agreement, the Consumer may demand:
Repair or replacement of the Goods.
The Seller may carry out a replacement when the Consumer demands a repair, or the Seller may carry out a repair when the Consumer demands a replacement, if bringing the Goods into conformity with the agreement in the manner chosen by the Consumer is impossible or would require excessive costs for the Seller.
The Consumer may submit a statement of price reduction or withdrawal from the agreement when:
The Seller refused to bring the Goods into conformity with the agreement;
The Seller did not bring the Goods into conformity with the agreement within a reasonable time;
The lack of conformity of the Goods with the agreement persists even though the Seller attempted to bring the Goods into conformity with the agreement;
The lack of conformity of the Goods with the agreement is significant enough to justify a price reduction or withdrawal from the agreement without first using the remedies from point 5.

The Seller will respond to the complaint within 14 days of its receipt.
§ 9. OUT-OF-COURT METHODS OF HANDLING COMPLAINTS AND PURSUING CLAIMS
The Consumer has the option to use out-of-court methods of handling complaints and pursuing claims, including:
The right to apply to the permanent amicable consumer court operating at the Trade Inspectorate;
The right to apply to the Provincial Inspector of the Trade Inspectorate with a request to initiate mediation proceedings;
The ability to obtain free assistance in resolving a dispute from a district (municipal) consumer ombudsman or a social organization.

§ 10. FINAL PROVISIONS
Agreements concluded via the Online Store are concluded in the Polish language.
In matters not regulated by these Terms of Service, the provisions of Polish law apply, in particular the Civil Code, the Consumer Rights Act, the Act on Providing Services by Electronic Means, and the DSA Regulation.
The Seller reserves the right to make changes to the Terms of Service for valid reasons (e.g. changes in law, changes in payment or delivery methods). Customers will be informed of any change to the Terms of Service at least 14 days in advance on the website.
These Terms of Service take effect on the day they are published on the selico.eu website.
